Insurance-related Disputes

We have substantial experience in insurance matters, usually acting for claimants. We have handled cases involving avoidance for non-disclosure and/or misrepresentation, coverage disputes, illegality and insolvency.

We have experience of disputes involving policies in a number of areas, including bankers blanket bond, business interruption, D&O, professional negligence, credit guarantee, contractors' all risk, fidelity, permanent health and life insurance.

A selection of insurance-related matters which we have handled includes those where we have acted for:

  • a financial services business in a dispute with its professional indemnity insurers arising out of negligence claims being asserted against it by individuals who allegedly suffered loss by investing in split capital investment trusts. The claim was disputed on the grounds of misrepresentation, non-disclosure and late notification
  • a major financial institution in connection with property and business interruption insurance claims in the sum of approximately £20m following catastrophic damage to its London premises
  • a UK bank in connection with indemnity insurance claims relating to US litigation brought by the families of a number of people killed or injured in Hamas terrorist atrocities in Israel
  • a UK bank bringing a City Disputes Panel arbitration against about 40 insurers on its Bankers Policy for an indemnity for defence costs and settlement payments paid out in relation to various US proceedings
