London International Disputes Week 2024

Overview

We are delighted to again be taking part in London International Disputes Week (LIDW) 2024. Now in its fifth year, LIDW24 builds on the success of its previous events and strives to be a forward-thinking and inclusive forum for discussion.

With its theme, “Uniting for global challenge and opportunity”, LIDW24 will follow up on last year’s theme “Adapting to a changing world” and look not only at what progress has been made in the dispute resolution space over the last year, but also at what dispute resolution professionals around the globe can expect to see over the next year and beyond.

Securities Litigation: a new trend or old hat?

Securities litigation is an area that has seen a significant uptick in activity in the UK recently, with an increasing number of Section 90 and Schedule 10A FSMA claims being brought in the English courts. This follows the hand down of the liability judgment in HP/Autonomy v Lynch & Hussain in May 2022 – the first section 90A/Schedule 10A FSMA claim to have been considered at a full trial, with the judgment giving prospective claimants and litigators some clarity and confidence as to how the key features of such claims are to be addressed by the English courts.  But what does litigation of this nature actually look like in the UK, is it all that different to other types of mass claims, and how does it compare with the regimes in other jurisdictions, including the Netherlands?

Crypto Fraud: Interim relief in the English Courts

For many crypto disputes, the first step is an application for a proprietary injunction, or some other form of interim relief. Such relief can be critical to preserving the assets against which enforcement is sought, or to uncovering information material to formulating the claim. In this session, our speakers will discuss the key considerations when seeking interim relief in relation to cryptoassets, drawing from a wealth of experience. They will discuss the latest case law and highlighting the key takeaways arising out of those decisions.

Fraud: can it ever really be settled?

The principle that "fraud unravels all" sits uncomfortably with the strong public policy (and private interest) in the finality of settlement agreements.  In a series of cases, the English Court has grappled with these competing considerations with varying outcomes.  The panel will examine the balance struck in light of recent developments on this important issue for any party to proceedings involving allegations of fraud.
