Head of Dispute Resolution | Co-Head of ESG & Impact

Heather is a partner and Head of the Dispute Resolution practice.  She is also Co-Head of Travers Smith's ESG and Impact Group.

Heather has a broad commercial litigation practice, covering the spectrum of high-value and complex disputes (including large scale group claims); such disputes include environmental damage, human rights and product liability litigation. Heather has particular experience in novel and large-scale tort claims, including "parent company liability" claims, as well as in contractual disputes, competition law litigation, shareholder disputes and fraud cases. She is highly experienced in claims involving international and foreign law elements. Her clients include corporates, multinational organisations, banks, financial institutions and private equity houses with business interests across a broad range of sectors.

A particular aspect of Heather's practice is acting for clients facing reputationally sensitive litigation and investigations, and advising clients in relation to corporate risk management including business and human rights issues and ESG-related risk.  Her work in this space includes preventative counselling to clients facing potential ESG-related risk.

Heather was recognised in The Lawyer magazine’s 2019 Hot 100, which lists the profession's brightest and most innovative lawyers. She has been committed throughout her career to acting for pro bono clients on a range of disputes, including advising victims of domestic violence and abuse.

Heather was named as one of ten Distinguished Advisers by Financier Worldwide in their 'Power Players: Environmental, Social & Governance 2024' report, in recognition of the leading role she plays in highlighting the importance of ESG in the regulatory and operational issues businesses need to manage, and bringing an innovative yet practical approach to this fast-moving area of law.

WORK HIGHLIGHTS

Leading the defence of two separate sets of proceedings against Camellia plc and two of its English subsidiaries involving novel "parent company liability" claims concerning alleged human rights abuses in the operations of two overseas subsidiaries of the Camellia group in Kenya and Malawi respectively.

Acting for Japanese smart card chip producer Renesas in a combined follow on and standalone damages claim brought in the High Court by Vodafone against our client and another addressee of the European Commission SmartCard Chips cartel decision.

Acting for the shareholders and non-executive directors of a foreign bank following discovery of a high-value fraud, defending various claims of breach of duty and misconduct and bringing a counterclaim for their losses as shareholders.

Acting for the former directors of an insolvent company defending various claims against them including breach of duty and under the Insolvency Act 1986.

Acting for clients bringing high value professional negligence claims.

Acting for a key witness in a £2 billion fraud trial involving a private equity house and a US investment bank.

Acting for various clients on sensitive internal and regulatory investigations.

Acting for various corporates in relation to product liability claims and alleged breaches of product safety regulations.

Advising in relation to the establishment of Operational-Level Grievance Mechanisms consistent with UN Guiding Principles on Business and Human Rights.
